PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS LEGAL RIGHTS.

This agreement includes a release of liability, assumption of risk, indemnification obligations, and a media release.

This Volunteer Release, Waiver of Liability, Assumption of Risk, Media Release, and Consent Agreement is entered into by the undersigned individual, referred to as the “Volunteer,” or, if the Volunteer is under eighteen years of age, by the Volunteer’s parent or legal guardian.

In consideration for being permitted to participate in volunteer activities conducted by or in connection with 180 Your Grief, Inc. DBA Widow Strong and the Event, the Volunteer agrees as follows:

1. Voluntary Participation

Volunteer acknowledges participation is entirely voluntary and unpaid.

Volunteer understands participation does not create an employment, contractor, agency, partnership, joint venture, workers’ compensation, insurance, or employee benefits relationship with the Organization.

Volunteer agrees to comply with all volunteer policies, safety procedures, instructions, and directions issued by Organization leadership or designated event representatives.

The Organization reserves the right to deny, limit, suspend, or terminate participation at any time for safety concerns, misconduct, unlawful conduct, policy violations, disruption, or conduct inconsistent with the Organization’s mission.

2. Event Activities

Volunteer understands activities may include, but are not limited to:

  • Landscaping, gardening, planting, and site enhancement
  • Construction, maintenance, enhancement, and improvement projects
  • Loading, unloading, lifting, carrying, and moving materials and supplies
  • Use of hand tools, power tools, landscaping tools, construction tools, and related equipment
  • Use of wheelbarrows, carts, ladders, edging equipment, digging tools, compacting tools, and similar equipment
  • Gravel installation, mulching, planting, and site preparation
  • Walking and working on uneven, wet, elevated, unstable, or outdoor surfaces
  • Food preparation, serving, hospitality, and event support
  • Outdoor work involving weather exposure, heat, allergens, insects, dust, and environmental conditions
  • Activities involving interaction with participants, families, and children

Volunteer understands Activities may occur on property owned, controlled, operated, maintained, or managed by third parties.

Volunteer acknowledges the Organization cannot guarantee that all conditions, premises, equipment, tools, weather conditions, or actions of participants, contractors, volunteers, or third parties will be free from hazards.

Volunteers under eighteen years of age may not operate power tools, construction equipment, motorized equipment, or other equipment designated by Organization leadership.

3. Assumption of Risk

Volunteer understands participation may involve known and unknown risks including, but not limited to:

  • Slips, trips, and falls
  • Lifting injuries
  • Dehydration
  • Heat exposure
  • Weather conditions
  • Dust and allergens
  • Insect exposure
  • Uneven terrain
  • Use of tools or equipment
  • Transportation risks
  • Illness exposure
  • Emotional distress
  • Property damage
  • Serious bodily injury
  • Permanent disability
  • Death

Volunteer certifies Volunteer is physically capable of participating and voluntarily assumes all known and unknown risks associated with participation.

Volunteer expressly acknowledges participation may include voluntary use of construction equipment, landscaping equipment, power tools, hand tools, ladders, and related equipment.

Volunteer understands such activities involve inherent and potentially dangerous risks including cuts, falls, strains, crushing injuries, equipment malfunction, operator error, contact with moving parts, property damage, serious bodily injury, permanent disability, and death.

Volunteer knowingly and voluntarily assumes all risks associated with participation and with use of such tools and equipment, whether owned, provided, operated, maintained, or made available by the Organization, event partners, contractors, property owners, other volunteers, or third parties.

4. Release and Waiver of Liability

For purposes of this Agreement, “Released Parties” means:

180 Your Grief, Inc. DBA Widow Strong and its current and former directors, officers, employees, volunteers, contractors, representatives, agents, successors, assigns, event partners, sponsors, property owners, affiliated organizations, and participating ministries and entities supporting the Event, including, without limitation:

  • Love Atlanta
  • Passion City Church
  • The Home Depot Foundation
  • Chastain Park Conservancy
  • Each of their respective directors, officers, employees, volunteers, contractors, representatives, affiliates, successors, and assigns

To the fullest extent permitted by Georgia law, Volunteer releases, waives, forever discharges, and agrees not to sue the Released Parties from any and all claims, liabilities, losses, expenses, damages, causes of action, costs, and demands arising out of or relating to participation.

This includes claims for bodily injury, illness, death, emotional injury, property damage, medical expenses, lost income, or economic loss.

This release applies whether arising from acts, omissions, premises conditions, equipment, transportation, activities, or other circumstances related to participation.

Nothing in this Agreement releases claims arising solely from gross negligence, intentional misconduct, or conduct that cannot legally be waived.

5. Indemnification

To the fullest extent permitted by law, Volunteer agrees to defend, indemnify, and hold harmless the Released Parties from claims, damages, liabilities, losses, costs, expenses, judgments, settlements, and reasonable attorneys’ fees arising from Volunteer’s own acts, omissions, misconduct, unlawful conduct, negligence, violation of policies, misuse of tools or equipment, operation of vehicles, or failure to follow instructions.

This provision shall not apply to claims arising solely from gross negligence or intentional misconduct.

6. Medical Authorization

Volunteer authorizes the Organization to obtain emergency medical care if Volunteer becomes ill or injured and emergency contact cannot reasonably be reached.

Volunteer accepts full responsibility for resulting costs.

The Organization does not provide health, accident, disability, workers’ compensation, or medical insurance.

7. Transportation

Volunteer shall not operate a vehicle during Activities unless properly licensed and insured.

Volunteer assumes all transportation risks associated with travel to and from event locations.

8. Media Release and Perpetual Use Rights

Volunteer grants the Organization, Released Parties, affiliates, successors, licensees, media partners, and designees the irrevocable, perpetual, worldwide, royalty-free right to photograph, record, reproduce, edit, modify, publish, display, distribute, transmit, create derivative works from, and otherwise use Volunteer’s name, likeness, image, voice, appearance, and statements in any media now known or later developed.

Use may include promotional, fundraising, educational, archival, website, social media, advertising, broadcast, documentary, and mission-related purposes.

Volunteer waives rights to inspect, approve, revoke, or receive compensation.

Volunteer understands media may remain publicly accessible indefinitely.

9. Child Safety

Volunteer understands that children and families may be present during Activities.

Volunteer agrees that interactions with minors shall occur only within the ordinary scope of event participation and in public or observable settings.

Volunteer shall not assume responsibility for supervision, custody, transportation, overnight care, counseling, private communication, private meetings, one-on-one care, or removal of a minor from a parent, guardian, or authorized event leader.

Volunteer acknowledges that parents and legal guardians remain responsible for the supervision, care, and custody of their own children during Activities unless otherwise expressly authorized by the child’s parent or legal guardian and approved in advance by the Organization.

Volunteer agrees to immediately report any safety concern involving a child to Organization leadership.

10. Confidentiality

Volunteer agrees not to disclose confidential information learned through participation relating to participating families, children, donors, volunteers, operations, or financial information.

12. Severability and Electronic Signatures

If any provision is held unenforceable, remaining provisions remain effective.

Electronic signatures and digital acceptance shall carry the same legal effect as original signatures.
